Chips Fall the Wrong Way for Alleged Burglar

Police said a man was caught taking items from a Subway shop.

A Vernon man's quest for a midnight snack was interrupted by an officer responding to an alarm call early Thursday morning, according to an arrest report.

The alarm went off at 12:19 a.m. at the Subway sandwich shop at 69 Windsor Ave. - Route 83 - according to an arrest report. An officer arrived in the parking lot and saw Michael Anthony Smith, 23, standing near a smashed-in window, grabbing snack-sized bags of chips, according to an arrest report.

Smith lives down Route 83 - at 173 Talcottville Road - police said.

Smith was detained at the scene and then arrested after a brief investigation, police said.

For the incident, he was charged with:

• Third-degree burglary.
• First-degree criminal mischief.
• Two counts of sixth-degree larceny.

Police also charged Smith with possessing less than 4 ounces of marijuana, an arrest report indicates.

He was being held on a $7,500 bond while awaiting a Thursday court appearance, police said.

Police said he used a piece of firewood to break the window, likely from an adjacent hardware store.

Smith apparently took the healthy route - Sun Chips and Baked Lay's potato chips were the items allegedly taken, according to an arrest report.
